1.2 'Seller' refers to any merchant, store, or restaurant listing products/services on Sarwam.

1.3 'Delivery Partner' includes restaurants providing self-delivery and individual delivery partners registered with Sarwam.

1.4 'Logistics Partner' refers to third-party delivery providers integrated with Sarwam.

1.5 'Platform' refers to the Sarwam application and website.

2.1 Buyers acknowledge that prices displayed on the home screen product cards marked with a star (*) are indicative only. Such prices are subject to availability, may vary depending on the number of restaurants or sellers, and Sarwam does not guarantee the exact amount shown on these cards.

2.2 Users must provide accurate information while registering or placing orders.

2.3 Sarwam reserves the right to suspend accounts found engaging in fraudulent or abusive practices.

3.1 Buyers are responsible for ensuring order details are accurate before confirming.

3.2 Payments must be made through the payment options available on the platform.

3.3 Refunds and cancellations will follow Sarwam's refund policy.

4.1 Sellers must ensure that all listed products and services comply with applicable laws.

4.2 Sellers are responsible for maintaining accurate stock and pricing information.

4.3 Any disputes between Buyers and Sellers will be mediated by Sarwam where possible, but Sarwam is not liable for such disputes.

5.1 Restaurants providing self-delivery and individual delivery partners must ensure timely and safe delivery of products.

5.2 Delivery partners must comply with traffic regulations and safety standards.

5.3 Delivery partners must not engage in fraudulent activities or misuse Buyer information.

6.1 Logistics partners are responsible for ensuring reliable delivery services.

6.2 Sarwam is not liable for delays or damages caused by logistics partners.

6.3 Logistics partners must comply with applicable laws and regulations.

7.1 Buyers agree to pay the final order value as displayed during checkout.

7.2 Sellers and Delivery Partners agree to any subscription or service fees as communicated by Sarwam.

7.3 Sarwam reserves the right to revise charges at any time with prior notice.

8.1 Cancellation and refund eligibility will depend on the Seller's and Sarwam's policies.

8.2 Delivery charges may not be refundable once delivery has been initiated.

8.3 Returns or exchanges are only applicable for non-perishable items where sellers explicitly allow.

8.4 Perishable food items are non-returnable once delivered.

8.5 Refunds, if applicable, will be processed as per Sarwam's payment policy.

9.1 Sarwam respects user privacy and handles personal data as per its Privacy Policy.

9.2 Users consent to Sarwam sharing necessary details with Sellers, Delivery Partners, and Logistics Partners for order fulfillment.

10.1 Users must not misuse the platform for unlawful activities.

10.2 Sellers must not list prohibited items.

10.3 Delivery Partners must not engage in unsafe or illegal practices.

11.1 Sarwam acts as a facilitator between Buyers, Sellers, and Delivery/Logistics partners and is not directly responsible for the quality of products or services.

11.2 Sarwam will not be liable for delays, damages, or losses caused by third parties.

12.1 Sarwam reserves the right to update these Terms and Conditions at any time.

12.2 Continued use of the platform after updates constitutes acceptance of revised terms.

13.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

13.2 Any disputes will be subject to the jurisdiction of the courts in Kolkata, West Bengal.
